In numerous applications in Germany, the legal framework for the use of electronic signatures is still lacking because the electronic form was explicitly excluded, or the written form is provided for, where the use of text with conclusive proof of delivery could also be sufficient.
Habib Bejaoui and Jörg Lenz specifically highlight recent and upcoming changes to the legal framework for digital processes through the Fourth Bureaucracy Relief Act (BEGIV) and the Vocational Training Validation and Digitisation Act (BVaDiG).
Among other things, the possibilities for using trust services for employment contracts with and without fixed terms, contracts for temporary employment (temporary work) and training, proof of essential working conditions in accordance with the Verification Act and applications for part-time work and parental leave will be discussed. Reference is also made to recommendations from leading experts in labour law.
